Information requested

The provision of electronic copies of draft versions of the Public Health Scotland reports into discharges from hospitals to care homes in the initial months of the pandemic, and in relation to electronic correspondence dated between 1 April 2020 and 14 June 2021 held in relation to discussions surrounding the reports.

Electronic copies of all draft versions of each of these two separate reports sent to the Government between 1 April 2020 and 21 April 2021; and Electronic copies of any correspondence (including but not limited to emails, letters and meeting minutes) between Scottish Government and a) relevant PHS staff, and b) relevant University of Glasgow and Edinburgh staff, in relation to either of these two reports between 1 April 2020 and 14 June 2021.

Response

Please find attached copies of most of the information you requested. Per your second point, electronic copies of correspondence and communications held by Scottish Government, dated between October 14 and October 28 2020 was subject to FOI 202100133299 and is all publicly available. An exemption under section 38(1)(b) of FOISA applies to a small amount of the information you have requested. This is because the information requested contains personal data of a third party, i.e. the names contact details and e-mail addresses of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
