Information requested

1. Any correspondence between the First Minister, the Health Minister, their special advisers, and the civil service between the dates of January 10 to January 20 on the topic of the vaccine deployment plan 2021 published on January 14. 1a. This should include - but is not limited to - any correspondence on that topic that includes the reasons why or discussion of the decision to delete the plan from the Scottish Government website. 2. Any correspondence from the UK Government to the Scottish Correspondence between January 11 and January 14 requesting the deletion of the vaccine deployment plan 2021 and the email chains in which that request was made and the responses to it.

Response

I have concluded that a different decision should be substituted. This decision was reached after a review of the searches performed during the initial search carried out with your request. This has resulted in the decision to not apply Section 12 of the FOISA and to provide the information that you requested in your original request. We apologise for any inconvenience caused by this and have taken steps to ensure that staff performing the searches are performing these correctly. Attached is a copy of most of the information requested. An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data concerning individual’s names and contact details. Disclosing this would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
