Information requested

Communications between the Scottish Government and a group titled LGB Alliance (directors: Malcolm Clark, Katharine Harris, Beverley Jackson and Ann Sinnott) from October 2019 to the date of this request.

Response

Attached are copies of some of the information requested. In regards to the attached letter of 27 November 2019 addressed to Fiona Hyslop MSP, Cabinet Secretary for Culture, Tourism, Europe and External Affairs, a response was taken forward by National Records of Scotland (NRS). For the purposes of FOI legislation, NRS are not part of the Scottish Government. It may therefore be helpful to contact NRS directly for a copy of their response. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reasons why that exemption applies are explained below. An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, consisting of the names, email addresses and telephone numbers of some officials in Scottish Government and the email addresses of some individuals outwith Scottish Government. Disclosing this would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
