Information requested

From 1 October 2020 to present: Copies of all emails to and from Michael Russell with the word ‘referendum’ in them (including in the email body, as an attachment, in the subject line and/or otherwise).

Response

In order to determine which areas of the Scottish Government were required to search for information, we have interpreted your request to relate to independence referendum matters, rather than EU referendum matters, based on your previous FOI requests. If you do require information relating to the EU referendum, a further request can be submitted and searching will be carried out in the appropriate policy areas. I enclose a copy of some of the information you requested, this information is enclosed at Annex A. While our aim is to provide information whenever possible, exemptions under Section 25(1) (information otherwise accessible), Section 30(b)(i) (free and frank provision of advice), Section 30(b) (ii) (Free and Frank Provision of Views), Section 30(c) (effective conduct of public affairs), Section 36(1) (legal advice) and 38(1)(b) (Personal Information) of FOISA applies to some of the information requested. The reasons why these exemptions apply are explained in Annex B of this letter.
