Information requested

All email correspondence between Minister Roseanna Cunningham (and civil servants working on her behalf) and the research team at Natural Research regarding the production of Scottish Natural Heritage Commissioned Report No. 982, Analyses of the fates of satellite tracked golden eagles in Scotland.

Attached is a copy of the information requested.

An exception under Regulation 11(2) of EIRS (personal information) applies to a small amount of the information requested because it is personal data of a third party, ie names, contact details and job roles and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. While our aim is to provide information whenever possible, under regulation 11(6) of the EIRs, a public authority may respond to a request by not revealing whether information exists or is held by it, if to do so would involve making information available in contravention of regulation 11. Regulation 11(2) provides that where the information requested includes personal data about a person other than the applicant and disclosure would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998, the public authority shall not make that personal data available.

This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
