Information requested

Your request followed an earlier request about the Scottish Government’s Fairness at Work process (FOI/19/01911).

In your request, you asked for information about ‘the age, gender, disability, grade, qualification held length of service of both the complainant(s) and the respondent(s) and of course the outcome’.

Response

You have asked for information about Scottish Government employees and the Scottish Government’s Fairness at Work process. This response therefore covers staff who are employed by the Scottish Government and who were either the respondent or the complainant in the Fairness at Work process.

While our aim is to provide information wherever possible, I am unable to provide all the information you have requested because an exemption under section 38(1)(b) of FOISA applies. That exemption applies because the information is personal data of a third party/parties, and disclosing it would contravene the data protection principles set out in the General Data Protection Regulation (GDPR), Regulation 2016/679 and section 34(1) of the Data Protection Act 2018.

Our response to your request is set out at the Annex.
