Information requested

Any written or recorded communication between the Scottish Government and The Moray Council (whether councillors, the chief executive or other officers) in the months of December 2018 and January 2019 relating to the Scottish Government’s draft budget for 2019-20 or Moray Council’s own budget or where these issues were discussed.

The dates and times of any meetings or telephone calls between the Scottish Government and The Moray Council’s chief executive or other officers in the months of December 2018 and January 2019 relating to the Scottish Government’s draft budget for 2019-20 or Moray Council’s own budget or where these issues were discussed.

Any read-outs or minutes that have been distributed either to The Moray Council or internally within the Scottish Government relating to any such meetings.

I attach a copy of the correspondence you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information (names and contact details of some individuals) contained in the correspondence you have requested because an exemption under section 38(1)(b) of FOISA applies to that information.

An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information contained in the correspondence you have requested because it is personal data of a third party, i.e. names and contact details of some individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
