You asked for information regarding a potential inquiry into undercover policing in Scotland and the Scottish Government's decision not to order an independent Scottish inquiry for the period from 17/01/17 to the present day.

Response

Some of the information you have requested is available. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections of FOISA applies to that information:

29(1 )(a) - formulation or development of government policy 29(1 )(b) - Ministerial communications 30(a) - substantial prejudice to the convention of collective responsibility of Scottish Ministers 30(b)(i) - substantial inhibition of free and frank provision of advice 30(b)(ii) - substantial inhibition of free and frank exchange of views for the purpose of deliberation 30(c) - substantial prejudice to the effective conduct of public affairs, 36(1) - confidentiality in legal proceedings 38(1)(b) - personal data
