Information requested

I would like to ask how much time do Social Security Scotland have to send all the details about an individual's case to the First-tier Tribunal after requesting an appeal.

There is information on mygov.scot that Social Security Scotland have 7 working days to do so. I am not able to find any detailed legislation on this time frame.

Response

The timescale referred to is set out in operational data sharing arrangements between Social Security Scotland and the Scottish Courts and Tribunals Service. It is not prescribed in legislation. There is no legislative requirement for such agreements to be routinely published.

This document explains that Social Security Scotland will send the client’s appeal request to the Scottish Courts and Tribunal Service within 7 days of receiving the appeal request.
