1.With regards to the duelling of the A9, which companies have been awarded contracts for (a) asphalt and (b) concrete, and what was the value of these contracts?
2. In each of the past three years, what contracts have been awarded to (a) Tarmac, and (b) Aggregate Industries / Holcim UK; and what was the value of these contracts?

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.
We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
1. With regards to the duelling of the A9, which companies have been awarded contracts for (a) asphalt and (b) concrete, and what was the value of these contracts?
While our aim is to provide information whenever possible, in this instance Transport Scotland does not have some of the information you have requested. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have.
We hold information on the subcontractors for (a) asphalt and (b) concrete appointed by
Transport Scotland’s contractors, but do not hold the subcontract values in all cases as the appointment of subcontractors for all of Transport Scotland major projects is the responsibility of the appointed project contractor.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. While we recognise there may be some public interest in the value of sub-contracts awarded contracts for (a) asphalt and (b) concrete, clearly we cannot provide information which we do not hold.
We hold the following information regarding the A9 Dualling Programme Projects at the date of your request:
A9 Dualling: Luncarty to Pass of Birnam project:
- Breedon Northern Limited was awarded a subcontract by Balfour Beatty Civil Engineering Limited for surfacing and cement bound granular material.
A9 Dualling: Kincraig to Dalraddy project:
- Breedon Group were awarded a £10m subcontract by Wills Bros Civil Engineering Limited to supply Drystone, Asphalt and Ready mixed concrete.
A9 Dualling: Tomatin to Moy project:
- Leiths (Scotland) Limited were awarded a subcontract by Balfour Beatty Civil Engineering Limited for temporary and initial surfacing works. Subcontracts have not yet been awarded by Balfour Beatty Civil Engineering Limited, for (a) asphalt and (b) concrete.
A9 Dualling Tomatin Distillery Advance Works
- Breedon Group were appointed by Wills Bros as the subcontractor for both (a) asphalt and
(b) concrete as part of the A9 Tomatin Distillery advance works.
2. In each of the past three years, what contracts have been awarded to (a) Tarmac, and (b) Aggregate Industries / Holcim UK; and what was the value of these contracts?
I can confirm that Transport Scotland has not directly awarded any contracts to (a) Tarmac, or
(b) Aggregate Industries / Holcim UK in the past three years.
As outlined above, the appointment of subcontractors for all of Transport Scotland major projects is the responsibility of the appointed project contractor.
