Information requested

All documentation the Scottish Government holds on discussions with Scottish Care regarding Anne's Law and its implementation, including correspondence, minutes and notes from meetings. For the period June 2022 to February 2025.

Response

I enclose a copy of most of the information you have requested. While our aim is to provide information whenever possible, in this instance we are unable to provide a small amount of the information you have requested because an exemption under section 38(1)(b) of FOISA (personal information) applies. This is because it is personal data of a third party, i.e. names and contact details of individuals. Disclosing this information would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

To note, we have supplied information relating to direct engagement between Scottish Care and the Scottish Government. Scottish Care were present alongside other stakeholders in meetings about Anne’s Law of which the notes can be supplied via a subsequent request if that would be of interest to you.
