Information requested
All briefing notes, speaking notes, emails and other written communication, including Whatsapp and text messages, to and from the First Minister relating to Stracathro Hospital between December 1 2024 and January 28 2025.
Response
I enclose a copy of most of the information you requested.
Some of the information you have requested is available from Written question and answer: S6W-34287 | Scottish Parliament Website and Improving public services and NHS renewal: First Minister's speech - 27 January 2025 - gov.scot
Under section 25 of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the websites listed, then please contact me again and I will send you a paper copy.
The reasons why that exemption applies are explained in the Annex to this letter.
ANNEX
Section 25: Information otherwise accessible
An exemption under section 25 of FOISA applies to some of the information you have requested. Section 25 of the Freedom of Information (Scotland) Act 2002 (FOISA) exempts information from disclosure where the requester can reasonably obtain the information without asking for it under FOISA. This includes information already published on the Scottish Government website and Scottish Parliament website.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
