Response
I enclose a copy of some of the information you requested.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under s.27(1) (Information intended for future publication), s.38(1)(b) (personal information), section 29(1)(a) (Formulation or development of Scottish Government policy) and s.30(b)(a) (Free and frank exchange of views) applies to this information.
Section 38(1)(b) is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
Section 27(1), Section 29(1)(a) and Section 30 (b)(a) is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release because this of the need for an open and transparent government. However, this is outweighed by the public interest in high quality policy and decision-making, and in the properly considered implementation and development of policies and decisions.
The answers to your questions are as following:
1. Information on all current Members of the First Minister’s National Advisory Council on Women and Girls can be found on the NACWG website. 2. Please see attached. 3. Please see attached.
