Information requested

1. How much money was ingathered from citizens who failed to be discharged for their protected trust deed (PTD) from April 2018 to March 2023? If possible, please can you give a breakdown of each year.

2. Can you confirm how many citizens who failed to be discharged from a PTD in each year were in receipt of an income-related benefit such as Housing Benefit, Universal Credit, Employment Support Allowance (income-based) or income support detailed on their CFT when the application was submitted for protection.

3. The current live caseload of PTDs how many citizens had an income-related benefit noted in their CFT when the application was submitted for protection.

4. What was the average length of time from a PTD being protected to the PTD failing and the citizen being refused their discharge for each year?

I enclose a copy of some of the information you requested.

The response to questions 1,2 and 5 can be found on the attached spreadsheet. To provide some context, I have added the number of trust deeds that came to an end without the debtor being discharged in each of these years, the average payments made in those trust deeds, and the number of trust deeds that successfully completed in each of the same years.

While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested for questions 3 and 4 would exceed the upper cost limit of £600. The reason for this is because the Accountant in Bankruptcy does not record this specific information on our case management system. I would have to search each individual trust deed protected in this period (33,028 cases). Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.
