Information requested

I would like to request under the Freedom of information act any and all Scottish Government correspondence with NHS Lanarkshire concerning the Baby Loss/ Miscarriage units due to open soon. Including any correspondence from previous Minister for Women’s Health Maree Todd.

I would also like details of any and all meetings that have taken place concerning this issue with dates and minutes.

Response

I enclose a copy of an email exchange between Scottish Government officials and NHS Lanarkshire, concerning the bereavement space in NHS Lanarkshire, in a pdf format.

The names and email addresses of officials of the Scottish Government and NHS Lanarkshire have been redacted under Freedom of Information (Scotland) Act 2002, Section 38 (1) (b) exemption. The reasons why this exemption applies is explained in the annex below.

ANNEX

An exemption applies

An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party, ie names, titles and contact details of officials of the Scottish Government and NHS Lanarkshire, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
