Research of the offence of insider dealing: FOI release
Information requested
Information under the Criminal Justice Act 1993 Part V (notably s.52) : 1. How many prosecutions for insider dealing have occurred in Scotland in the previous 10 years? 2. How many were successful prosecutions? 3. How many cases were disposed before successful conviction?
Response
Our records show there have been no prosecutions under section 52 of the Criminal Justice Act 1993 between 2010-11 and 2019-20. There have also been no prosecutions under other legislation for the crime of 'insider dealing' during this time period. There were no proceedings in our data where there was a deserted simpliciter recorded or where proceedings were dropped after a person had been called to court . We do not hold information where proceedings were started but dropped before they reached court. The Scottish Government Criminal Proceedings database is not a live system and the latest available information is for the financial year 2019-20. Information for 2020-21 will not be available until publication of the Criminal Proceedings in Scotland, 2020-21 Statistical Bulletin. This is due to be published later this year.
