The answer to your question is no, the Clean Air & Environment Act 2005 applies only to England & Wales. There are a variety of relevant pieces of legislation for Scotland which cover the topics within the 2005 Act, for example, The Environmental Protection Act 1990 and the Environmental Noise (Scotland) Regulations 2006.
