Information requested

1) The terms applied by the Scottish Government to the grant and loan funds made available to Scottish Rugby Union Limited comprising £15 million in grants and £5 million in loan funding.

2) A copy of the conditional missive agreed between the Scottish Government and Scottish Rugby Union Limited for these funds.

3) Copies of any correspondence such as letters, minutes, emails, attachments or otherwise on the decisions to allocate this emergency funding to Scottish Rugby Union Limited from the period of 1 September 2020 to date of submission.

Response

I am writing to advise that following your appeal to the Scottish Information Commissioner, we have now given further consideration to the information held within the scope of your request .

During the course of this investigation I have identified one additional document which would fall within part one of your request. A letter from Dominic McKay dated 27 January 21 and signed on 28 January 21. I apologise that this information was not identified when responding to your request and review and attach a copy of this with this response.

I have also identified one further document falling within part three of your request. A copy of the Indicative Funding package for Sport document was disclosed to you in response to your request reference 202000130487 during the appeal investigation into that case, however as it was not available to you when you made this request on 26 March 2021. I have therefore attached a further copy of this document with this response.

An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information in each of these documents because it is personal data of a third party, e.g. names/contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Finally, some information has been redacted from the Indicative Funding package for Sport document because it does not fall within the scope of your request. This is because it does not relate to Rugby.
