Information requested
1. All correspondence (via email, text message, letter etc) between Scottish Government ministers and officials with Police Scotland staff regarding the Kenmure Street protests in Glasgow. 2. All call logs between Scottish Government ministers and officials with Police Scotland staff on the days immediately prior to, the day of and the days following the Kenmure Street protests in Glasgow.
Response
1. Regarding all correspondence (via email, text message, letter etc) between Scottish Government ministers and officials with Police Scotland staff regarding the Kenmure Street protests in Glasgow. A redacted email can be found in Annex A. While our aim is to provide information whenever possible, in this instance we are unable to provide a small amount of the information because an exemption under section s.38(1)(b) (personal information) of FOISA applies. This is because it is the personal data of a third party, i.e. the names and contacts details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption. 2. Regarding all call logs between Scottish Government ministers and officials with Police Scotland staff on the days immediately prior to, the day of and the days following the Kenmure Street protests in Glasgow. The following calls took place during the course of 13th and 14th May:
At 1pm on 13th May between the former Cabinet Secretary for Justice and Mark Sutherland from Police Scotland. At 3pm on 13th May between Deputy Director of Police Division, Scottish Government and DCC Kerr from Police Scotland. At 9am on 14th May as part of a weekly meeting between the former Cabinet Secretary for Justice, the Chief Constable and DCC Kerr of Police Scotland. The minutes of this meeting can be found in Annex B.
