Information requested

1. Of the cases in the Civil Justice Statistics in Scotland 2018-2019 how many:

a) were made under section 114 of the Equality Act 2010; b) included a crave under the Equality Act 2010; c) were made/craved per protected characteristic; d) were made/craved per Sheriffdom; e) were made/craved per procedure (Simple, Ordinary etc)?

2. For each of the above please can you set out the number that were disposed of in any particular way (dismissed etc)?

Response

1a) While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested. The reason why we don't have the information is that the data we receive is not detailed enough to unpick cases registered under section 114 of the Equality Act 2010.

1b) 231 cases in 2018-19 included a crave under the Equality Act 2010. These are all craves, combining where Equality Act 2010 was a principal or an ancillary crave.

1c) While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested. The reason why we don't have the information is that the data we receive does not contain details about the protected characteristics involved.

1d) These are cases where Equality Act 2010 was a principal crave. We do not have sheriffdom data for cases where it was an ancillary crave.
