Information requested

Information 'relative to fines, prosecutions, confiscation of vehicles, etc', in connection with efforts to tackle 'boy racers'. As you will appreciate, the term 'boy racers' is a subjective one, without any precise definition in law or policy. I have understood your request to relate to careless, inconsiderate or antisocial driving.

I have attached a spreadsheet which provides data extracted from the Scottish Government Criminal Proceedings database, showing figures for prosecutions and convictions under section 3 (Careless, and inconsiderate, driving) and section 34 (Prohibition of driving mechanically propelled vehicles elsewhere than on roads) of the Road Traffic Act 1988.

This is the only information the Scottish Government has that is of direct relevance to your request. It should be noted that data on the Scottish Government Criminal Proceedings Database relates only to the main charge in each case. I am advised that the Scottish Courts and Tribunals Service may be able to provide more detailed information about charges, and about confiscation of vehicles. As mentioned in my email of 22 January, any substantive information about the police approach to tackling issues of careless, inconsiderate or antisocial driving, including the use of powers under section 126 of the Antisocial Behaviour (Scotland) Act 2004, would be best sought from Police Scotland directly.
