What percentage of cases submitted to the Scottish Government Compensation as a Result of Miscarriage of Justice scheme has been approved for compensation and what was the average amount of the compensation? Include years 2024, 2025 or related tax years.

The answer to your request is:

Since 1 January 2024 to the date of your FOI request (26 May 2026), there have been a total of 16 applications for compensation following a miscarriage of justice. Of these, 5 have been unsuccessful and 11 are still to be determined. The percentages are:

31% - unsuccessful 69% - to be determined None were successful

As none of the applications made between these dates have been found eligible for compensation, no compensation has been paid to any of these applicants.
