Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Q1. You requested the number of planned road closures on the A75 and A77 between the 1st and 30th June 2026.
A1. Transport Scotland's Operating Company, Amey, advise there has been no planned closures on the A75 and 7 planned closures on the A77 trunk roads during the period 01 - 30 June 2026.
Q2. You requested the number of unplanned road closures on the A75 and A77 between the 1st and 30th June 2026.
A2. There has been 1 unplanned closure on both the A75 and A77 trunk roads during the period 01 - 30 June 2026.
Q3. You requested the number of lane closures on the A75 and A77 between the 1st and 30th June 2026.
A3. There has been 2 lane closures on the A75 and 7 lane closures on the A77 trunk roads during the period 01 - 30 June 2026.
Q4. You requested the number of road traffic accidents reports on the A75 and A77 between the 1st and 30th June 2026.
A4. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. Transport Scotland does not have all of the information you have requested because records held by Transport Scotland relate only to collisions involving injuries or fatalities that have been reported to, and are known by, Police Scotland. As such, we do not hold records of collisions that resulted in damage only. Furthermore, accident data is only available up to 11 June 2026 at this time.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about the number of collisions on the A75 and A77 trunk roads for the period 01 June - 30 June 2026, clearly we cannot provide information which we do not hold.
There has been 2 collisions on the A75 and 0 collisions on the A77 trunk roads during the period 01 June - 11 June 2026.
