Information requested

A list of all internal and external meetings where the subject of the distribution of fishing quotas was discussed and all associated documents, since 7 May 2021.

I enclose a copy of most of the information you requested. Attached are the following files: “Documents 00-11” and “Document_Schedule of meetings and documents”.

Some of the information you have requested is available from https://rifg.scot/about/meetings, where minutes from FMAC meetings have been published. Similarly, the recent consultation and outcome, ‘Allocation of Scottish Additional Quota from 2024’, is available at Fish stocks: allocation of additional quota - Scottish Government consultations - Citizen Space, including the Consultation Outcome Report, Island Communities Impact Assessment and Business Regulatory Impact Assessment. There you can also access responses submitted to the consultation. Under regulation 6(1)(b) of the EIRs, we do not have to give you information which is already publicly available and easily accessible to you in another form or format.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

“Briefing materials, agendas, minutes and correspondence relating to those meetings” are subject to exception under Regulation 10(4)(e), “Formulation or development of Scottish Government policy”. This exception is subject to the public interest test in regulation 10(1). It is our decision that withholding the information outweighs the public interest in making it available.
