Vessel monitoring system (VMS) data for specific vessels: EIR release
Information requested
“I am writing to request information under the Environmental Information (Scotland) Regulations 2004 (EIRs).
I am seeking VMS data for vessels within the specified coordinates during the period from 01st March 2024 23:00 to 04th March 2024 01:00: P1: 59.9° N, -2.6° W P2: 59.9° N, -0.4° W P3: 58.4° N, -2.6° W P4: 58.4° N, -0.4° W
Please include the following details in the data: Date and time of report, Unique vessel identification, Latitude, Longitude, Course and Speed. I would prefer to receive this information in an Excel workbook format.”
Response
Before answering the question, we would like to clarify that: “Marine Scotland” is now known as the “Marine Directorate.” This is in order to align with the naming convention of other Scottish Government Directorates.

An exception under regulation 11(2) of the EIRs (personal information) applies to the unique vessel identification information because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.
This exception is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
