Information requested

All correspondence between COPFS, the Scottish Court Service and the Scottish Government regarding prosecutions of Post Office sub-postmasters since 2012.

I enclose a copy of some of the information you requested.

The Scottish Government does not have some the information you have asked for. We hold no correspondence between the Scottish Government and the Scottish Courts Service regarding prosecutions of Post Office sub-postmasters between 2012 and the date of your request.

Management of the Post Office is a reserved matter for the UK Government, and the Scottish Government has no role in the investigation of miscarriages of justice, which is a matter for the independent Scottish Criminal Cases Review Commission.

This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

An exemption under section 38(1)(b) (personal information) of FOISA applies to some of the information you have requested. Some of the information contains personal data of third parties, and this information has been redacted from the information provided.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
