Response

I applied a “reasonable interpretation” of this request to cover any correspondence leading up to notification of Professor Leitch’s intention to resign through to the issue of the press release on Tuesday 12 March 2024. I enclose a copy of the information requested as set out below.

Annex A: Copy of Professor Leitch’s letter to Director General, dated 11 March 2024, notifying his intention to resign Annex B: Copy of Permanent Secretary’s letter to Professor Leitch dated 12 March 2024 in response to his resignation Annex C: Submission to Ministers, dated 12 March 2024, notifying them of Professor Leitch’s intention to resign Annex D: Email exchange regarding Press Release clearance from First Minister, dated 12 March 2024 (Bands A-C staff names and any personal information has been redacted) Annex E: Director General’s email to Directors and Deputy Directors, dated 12 March 2024, notifying them of Professor Leitch’s resignation (Bands A-C staff names and any personal information has been redacted)

As set out above, exemptions under section 38(1) of FOISA apply to some of the information you have requested. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
