Information requested

Any internal Scottish Government communications regarding the introduction of a ‘minimum income guarantee’. Please can this include any briefing material produced in relation to this subject. I would like this information between 7 August 2021 and 24 August 2021.

I attach a copy of most of the information you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections s.25 (information otherwise accessible), s. 29(1) (formulation of policy) and s.38(1)(b) (personal information) of FOISA applies to that information. The reasons why those exemptions applies are explained in the Annex.

ANNEX REASONS FOR NOT PROVIDING INFORMATION

An exemption applies Exemptions under sections s.25 (information otherwise accessible), s. 29(1) (formulation of policy) and s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested.

S.25 (information otherwise accessible)) applies to minutes of a meeting, and all the papers of the meeting that was held. These have been published and can be found on the Scottish Government website. This section also applies to some e-mail exchanges that were in relation to drafting public facing communications that can be found online and additionally applies to the annex of a submission to the Cabinet Secretary. S.29(1) (formulation of policy) applies to a number of the documents that you requested. These documents contained either discussion on the formulation of the policy or information on other policy areas unrelated to the Minimum Income Guarantee and therefore were out of scope. S.38(1)(b) (personal information) applies to the names and e-mail addresses of officials that are involved with the Minimum Income Guarantee and therefore are not relevant.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
