The release of personal information/data relating to the subject case reference ( FOI - 202100146009).

Response

I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for an appeal in seeking the release of personal information/data relating to the subject case reference (202100146009).

I have concluded that a different decision should be substituted.

We apologise that your review dated 04/03/2021 did not receive a response, it was directed to a mailbox for allocation but unfortunately this mailbox had recently been decommissioned and we overlooked this.

We have rechecked the section 38(1)(b) exemptions applied to the document attached to your response and agree these have been applied incorrectly. Our normal practice is to apply section 38(1)(b) to the names of individuals, such as junior officials, who do not have a public profile, in order to protect their privacy.

However, in this instance, we mistakenly did so for individuals whose names we would normally release, We therefore, attach the document in full.
