Information requested
Please provide the exact same information as provided in FOI 202000114441, in response to points one and two broken down for the years i) 2010-11 ii) 2011-12 iii) 2012-13 iv) 2013-14 v) 2014- 15. Please also provide the data for 2020-21 up to the date of this new FOI request.
In addition, please also provide the data provided in response to points one and two of the above FOI request (i.e. the one in the above link: FOI-202000114441) specifically in relation to Edinburgh City Council broken down by each financial year from 2010/11 - 2020/21.
Response
The information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at Section 39(2) of the Freedom of Information (Scotland Act 2002 (FOISA) , so that we do not also have to deal with your request under the FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
Please find below, in tables 1 and 2, a breakdown of the information you requested.
Please note that Table 1 contains information relating to the first point in your request, that is to say, data broken down by the years 2010 to 2015 (inclusive) . Points 1c and 1d, below Table 1, responds to the latter part of your first point, regarding the additional period of 21 November 2020 until 26 January 2021.
Table 2 provides the information you requested, broken down by each financial year from 2010 to 2021( inclusive) in relation to the City of Edinburgh Council.
1. The number of planning appeals that have been overturned on appeal (as in column 1 a) and the number of valid planning permission appeals received ( as in column 1 b) in the period *20 November to 19 November for the years specified are held in the table below :
