All material relating to the handling of Parliamentary Question S5W-26056.

Please provide all information held relating to the above request, including but not exclusively all information held in the following formats: email, internal messaging, hardcopy, letter, file, report, graphic, publication, hand written notes, typed notes, minutes, and transcript. Please provide a copy of any internal Scottish Government documents (a) that were prepared to support ministers, or (b) by ministers, in relation to (i) the meetings, discussions and exchange of correspondence referred to in question 1.

Response

I enclose a copy of most of the information you have requested. Section 38(1)(b) of FOISA has been applied to the personal information of certain individuals. This exemption, and the reasons for application, are explained in full in the annex to this letter.

ANNEX REASONS FOR NOT PROVIDING INFORMATION An exemption applies An exemption under section 38(1)(b) of FOISA (personal information) applies to a small amount of the information requested because it is personal data of a third party – i.e. names and contact details of individuals - and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
