Please provide all correspondence (emails, typed or handwritten notes, letters, phone calls, minutes of meetings or otherwise) between members of the Scotcoin company and officials working for or in the Scottish Government.

Response

Please note that the information you requested is not held by the Scottish Government as this is a matter between these organisations. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested. With regards to your second request I can confirm that I have attached all documentation held by the Scottish Government that falls within the scope of your request. There has been some information redacted under section 38(1)(b) (Personal Information of a Third party) within the documentation and further details regarding these redactions can be found in Annex A of this letter.

ANNEX A REASONS FOR NOT PROVIDING INFORMATION An exemption under section 38(1)(b) of FOISA applies to some of the information requested because it is personal data of a third party, i.e names and contact details, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
