Response

I enclose a copy of the information you requested in the format discussed in our telephone conversation on 12 September. While our aim is to provide information whenever possible, in this instance – and as discussed with you - the Scottish Government has some but not all of the information you have requested. The reasons why we don’t have some of the information are explained in the Annex to this letter. ANNEX REASONS FOR NOT PROVIDING INFORMATION The Scottish Government does not have the information Section 17(1) of FOISA (information not held) requires the Scottish Government to notify you if it does not have some of the information you requested. The Scottish Government does not have the information you have asked for because some of the information requested, primarily the location of each active travel project, is not recorded. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have some of the information you have requested. An exemption applies An exemption under section s.38 (1)(b) of FOISA applies to some of the information you have requested. Specifically, this exemption applies to information that is considered to be personal data relating to third parties. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
