Further to my e-mail of 12 June 2019, I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for the supply of information between Scottish Government and Police Scotland/Scottish Police Federation on the proposed workplace parking levy.

Response

I have concluded that a different decision should be substituted.

I have looked at your case afresh, and have reconsidered all of the information we hold in relation to this request. I have determined that we were not entitled to apply an exemption under section 30(b)(ii) (free and frank exchange of views) to the information previously withheld.

I therefore enclose a letter dated 8 February 2019 from the Scottish Police Federation, and a reply dated 7 March 2019 from the Cabinet Secretary for Transport and Infrastructure, Mr Matheson. However, while our aim is to provide information whenever possible, we are unable to provide a small amount of information in this instance as an exemption under Section 38(1)(b) of FOISA continues to apply, for the reasons given in our previous response.
