1. I attach a copy of the comparable property information you requested at Question 1 and this is attached as Annex 1

2. The answer to your questions are:

In reply to your question 1: you asked specifically what properties in this area were used as comparators together with the rent charged for each property in relation to the decision dated 6th February 2019. Please see Annex 1 below, containing the 19 comparable rents used by the Rent Officer to make her decision dated 6th February 2019. I have redacted the property numbers from this list. I have also attached a link to the Fair Rent register where you can view your decision. http://www.gov.scot/fairrentregister

3. In reply to your question 2 (a): You asked me to explain why under “Allocation of Liability for Repairs” field on a decision letter, two different sections of legislation were quoted on decisions ranging from 1997 to 2019. Section 27 of the Housing (Scotland) Act 2001 supersedes s 113 and paragraph 3 of Schedule 10 of the Housing (Scotland) Act 1987. The text in this field was updated to ”as per missive of let in so far as it conforms to Section 27 of and Schedule 4 to, the Housing (Scotland) Act 2001”. Therefore decisions ranging from 1997 to 2019 will feature these 2 sections of legislation. This has no effect on your preserved rights as a tenant and this section is concerning provisions about the landlord’s obligations to repair a house let under a Scottish secure tenancy. Therefore there is no impact on you as a tenant.

4. In reply to your question 2 (b): You have asked about rental periods showing as calendar monthly or yearly on decisions. A decision letter may state rental amounts as calendar monthly or yearly and this amount equates to the same rent per annum.

5. In reply to your question 2 (c): You have asked me to explain what “none” means in the section relating to “level, rooms, description”. None recorded in this section means it is not relevant or there is not any recorded, e.g. there is no second floor (in the case of a flat) or a 3rd or 4th bedroom (if the property is a 2 bedroom) and therefore no entry is relevant.

6. In reply to your question 2 (d), (e) and (f) and point 3 (added): You have asked me to explain why 2 different registration numbers H0020994 and H0011475 were recorded, if they are specific to individual properties and last registration numbers being recorded. These are an internal registration and decision recording reference number on Rent Service Scotland’s database. This has no bearing on your unique property reference which is currently G062171. The previous last registration number is not always recorded on the Fair Rent Register and has no impact on any decision or subsequent decision. All previous decisions are superseded by the current decision, in this case dated 6th February 2019, as shown on the Fair Rent Register.

7. In reply to your question 3: you have asked me to note that you have access to a private garden on payment of an additional fee opposite, as matters stand at present. I have noted your comments.
