While our aim is to provide information whenever possible, in this instance we had to redact small amount of the information you have requested (document 3) because exemptions under sections 36(2)(actionable breach of confidence) and 38(1b)(personal data) of FOISA apply to that information. The reasons why that exemption(s) applies are explained below.
REASONS FOR NOT PROVIDING INFORMATION
An exemption applies
Exemptions under section 36(2)(actionable breach of confidence) and 38(1b)(personal data) of FOISA apply to some of the information requested because disclosure of that information may potentially lead to identification of individuals which would constitute an actionable breach of confidence and a prohibited release of personal data. This is because the information relates to third parties, is confidential, was provided in circumstances which imposed an obligation on the Scottish Government to maintain that confidentiality (in particular, it was obtained from research informants who participated in the research on the condition of confidentiality and anonymity guaranteed in a written and verbal agreement) and unauthorised disclosure would be to the detriment of the person who provided the information. These exemptions are not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
