Use of 'university' - restrictions and law: FOI release
Information requested
1. Whether the restrictions in Scotland on the use of the term 'university' in the name of a body are implemented by legislation 2. If so, what legislation.
I am aware of sections 44-49 of the Further and Higher Education (Scotland) Act 1992, which enable the Privy Council to consent to changes in names. I am looking specifically for the law which prevents use of the term 'university', which (for example) section 49(5) of that Act appears to make saving for.

The answers to your questions are as follows:
The restrictions on the use of the term university are set out in legislation. The relevant statutory provisions are set out in section 49 of the Further and Higher Education (Scotland) Act 1992, sections 55 and 1194 of the Companies Act 2006 and also in regulations made under that Act, the Company, LLP and Business Names (Sensitive Words and Expressions) Regulations 2014.
