Information requested

Information about road traffic collisions, which resulted in injury or fatalities, on the A82 between Crianlarich in the North and Balloch in the South for the following time periods: 2014, 2015, 2016, 2017, 2018 to date.

For each collision, I am seeking just a statement as to the time and date; the number of people injured or whether there was a fatality; I am also seeking the location - grid reference and latitude/longitude; and vehicle(s) involved.

Response

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

In response to your request, please refer to Annex A which is the Personal Injury Statistics for Crianlarich in the North and Balloch in the South for the time periods of 2014, 2015, 2016, 2017, 2018 to date.

An exception under regulation 10(5)(a) of the EIRs (prejudice to public safety) applies to some of the information you have requested in Annex A. This exception applies because disclosure of information such as the day and month of the incident would likely affect the physical or mental health of the individual involved or their families. We are however, able to provide you with the time and year of the incident.
