You asked for the following information:

for any letters or emails from teachers and/or teaching assistants to John Swinney or Nicola Sturgeon on P1 testing/assessment from 1 September 2018 to 23 January 2019.

I have also attached five separate pdf files with additional information. While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information. The reason why that exemption applies is explained in the Annex to this letter.

ANNEX An exemption applies

An exemption under section 25(1) of FOISA applies to some of the information requested – Information otherwise accessible. As this information is already in the public domain, we are not required to provide it. An exemption under section 38(1) (b) of FOISA applies to some of the information you have requested because it is personal data of a third party, ie names and contact details of individuals, and disclosing it would contravene the data protection principles set out in article 5(1) of the General Data Protection Regulation (GDPR) and section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
