While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections of FOISA apply. The reasons why these exemptions apply are explained below. Response: Under section 25(1) of FOISA, we do not have to provide information which is already reasonably accessible to you. Some of the information contained in the loan agreements has been withheld as it is commercially confidential and exempt under section 33(1)(b) – substantial prejudice to commercial interests. An exemption under section 36(1) of FOISA applies to some of the information requested because it is legal advice and disclosure would breach legal professional privilege.
