However, while our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under sections of FOISA, which are set out below, applies to that information. FOISA exemptions that applies to some of the that information requested are: 25(1) - Information otherwise accessible; 30(b)i - Prejudice to effective conduct of public affairs that would be likely to inhibit substantially free and frank provision of advice; 30(b)ii – Prejudice to effective conduct of public affairs that would be likely to inhibit substantially free and frank exchange of views for the purpose of deliberation; 33(1)b – Commercial interests and the economy that would likely to, prejudice substantially the commercial interests of any person (including, without prejudice to that generality, a Scottish public authority); 36(1) – Confidentiality of communications could be maintained in legal proceedings is exempt information; and 38(1)b – Personal information of a third party. The reasons why these exemptions apply are explained in Annex A to this letter.
