1)a) Details of any legal advice which Transport Scotland has received in relation to the applicability of the provisions of Section 36 of the Road Traffic Act 1988 to the reverse speed discrimination traffic signals at Springholm when the red signal phase is ignored by drivers. An exemption under section 17(1) of FOISA applies as no information is held in respect of the above question. This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.
