Information requested

The following information with regard to Transerve Scotland:-

1. For past five years i.e. from 20/12/2012 to date a detailed breakdown of the annual Revenue budget for the A77 from Whittlets roundabout to Stranraer for:

a. Repair of the road

b. Maintenance of the road

2. For the same period and place [as in 1 above]

a. How many complaints have been made about the road

b. How many claims for damages to vehicles have been made

c How many claims for vehicle damage have been paid, and the amount paid.

3. For the same period and place [as in 1above]:

How many potholes have:

a. been reported by members of the public

b. been repaired.

Response

I have numbered our response for ease of reference.

1a and b. While our aim is to provide information whenever possible, in this instance the Transport Scotland does not have the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. The reason why that exception applies is we cannot breakdown our investment figures down to a specific location, only by route. I can confirm that since 2012 the Scottish Government has invested £25 million on maintenance/repairs on the A77.

2a. As you may be aware the maintenance of the A77 is undertaken by Scotland TranServ on behalf of Transport Scotland. The contract for the maintenance of the road is the 4th Generation Term Contract for Management and Maintenance of the Scottish Trunk Road Network South West Unit which commenced on 1 April 2013. The table below shows how many complaints were received by the Operating Company from 1 April 2013 to 22 December 2017.

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have all of the information you have requested. Therefore we are refusing part of your request under the exception at regulation 10(4)(a) of the EIRs. The reason why that exception applies is that figures from 20 December 2012 to 1 April 2013 are not currently held.

2b. Scotland TranServ received 154 claims for compensation from 1 April 2013 to 20 December 2017. An exception at regulation 10(4)(a) of the EIRs has been applied to part of the response. The reason why that exception applies is that figures from 20 December 2012 to 1 April 2013 are not currently held.

2c. From 1 April 2013 to 8 January 2018, 15 claims have been paid by Scotland TranServ. While our aim is to provide information whenever possible, in this instance Transport Scotland does not have all of the information you have requested. Therefore we are refusing part of your request under the exception at regulation 10(4)(a) of the EIRs. The reasons why that exception applies is that under the 4th Generation Term Contract for the Management and Maintenance of the Scottish Trunk Road Network, (Schedule 1, Part 4 Indemnities and Insurance, Section 12.2), Scotland TranServ indemnify Scottish Ministers in relation to claims, therefore we have no involvement in this process and do not hold the information requested. 3a. The table below provides the number of complaints about potholes Scotland TranServ received from 1 April 2013 to 22 December 2017.
