You asked for particular information relating to the New Mull Campus Project.
Response
The answers to your questions are set out in the attached Annex. In addition I enclose a copy of some of the information you requested in your questions.
An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs. Where we do not have the information you asked for, this has been stated in the answer to the question.
In this instance we are also unable to provide some of the information you have requested because an exception(s) under regulation 12(5)(e) Confidentiality of commercial or industrial information of the EIRs applies to that information. This exception applies as the information is subject to commercial confidentiality. Specifically, the withheld information relates to tender pricing, cost breakdowns, and details which, if disclosed, could prejudice ongoing or future procurement exercises and undermine the ability to secure best value. Disclosure of this information would be likely to adversely affect the commercial interests of the organisations involved. The information that has been redacted does not relate directly to the site which is the subject of your request, but instead relates to other affordable housing projects which are included within the documents falling within scope of your request.
