You asked for "all correspondence between the Scottish Government and River Clyde Housing association, from November 1st 2024 to February 24th 2025."

I enclose a copy of the information you requested.

An exemption under section s.38(1)(b) of FOISA applies to some of the information you have requested. This is because some of this information is considered personal information. The information requested has therefore been provided with redactions to protect this third party data.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

However, where this information relates to communications clearly identified as relating to elected officials or the most senior officers of an organisation, we have considered that there is a public interest in disclosure and accordingly released this information.

Exemptions under sections 29(1)(d) and 39(1) of FOISA apply to some of the information you have requested. These exemptions relate to the operation of a ministerial private office and health and safety. This is because some of the information you have requested directly relates to confirmed details of a planned visit by a Scottish Minister, which might present some element of risk to the participants if they were disclosed in advance.

These exemptions are subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release because this supports transparency of Government. However, this is outweighed by the public interest in ensuring the safety and wellbeing of participants and the public, and does not preclude disclosure at a later date.
