Information requested

You asked for internal and external correspondence and minutes as below;

1) Any correspondence sent from Jenny Gilruth, in relation to the Scottish Government's 'Health and Wellbeing Census', since April 2025.

2) Any correspondence sent to Jenny Gilruth, in relation to the Scottish Government's 'Health and Wellbeing Census', since April 2025.

3) A copy of any meeting minutes that Jenny Gilruth attended, where the meeting has taken place within the last six months, relating to the Scottish Government's 'Health and Wellbeing Census.'

Response

I enclose a copy of most of the information you requested in the accompanying five attachments.

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information for your request 3. This is a formal notice under Section 17(1) of FOISA that the Scottish Government does not have the information you have requested as no meetings have taken place which are in scope.

An exemption under section s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested. This exemption applies because disclosure would involve releasing personal data of individuals which would contravene data protection principles under the UK GDPR and Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
