Information requested

How many times has a meeting taken place between NFU Scotland and Mairi Gougeon and or Jim Fairlie between December 2023 and December 2024? Please can you share the dates and times of these meetings? Between 2021 and December 2023 how many meetings took place between NFU Scotland and a member of the Scottish Government? Please can you also share the dates and times of these meetings?

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

Q4 request: Please can I request the following information: (4) Please can you also share the dates and times of these meetings?

Q4 response: Please see the table above (Table 3) for the dates as requested. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested, regarding specific timings and duration of the meetings. This is because The Scottish Government does not have some of the information you have asked for because Scottish Government standard records management protocol requires that Ministerial Outlook accounts (incorporating mailbox and calendar) must be maintained at a size (in GBs) which will not impact on functionality. This means that emails are retained for a maximum of three months, and calendars updated to retain only information required for archive. Ministerial meetings are proactively published on the Scottish Government website: https://www.gov.scot/collections/ministerial-engagements-travel-andgifts/

Detected exemption language

We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes.
