Information requested

All documentation held by the Scottish Government about Babcock between February 1 and May 1, including correspondence with or about them, minutes/notes from meetings with them, briefings prepared about them or analysis.

I enclose a copy of most of the information you requested .

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section 38(1)(b) (personal information) and section 25(1) (information otherwise accessible) of FOISA applies to that information.

An exemption under section 38(1)(b) of FOISA applies to some of the information you have requested because it is third party personal information and disclosing this personal data would contravene Article 21 of the UK GDPR (right to object to processing) and the public interest favours withholding the data (“the second condition”).

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption.

An exemption under section 25(1) of FOISA applies to some of the information you have requested because it is available in the public domain. The information you have requested can be found on the marine.gov.scot website.
