Information requested

"A copy of all guidance, manuals or other documentation relating to the operation of para. 5 of Schedule 3 to the Student Support (Scotland) Regulations 2022. Specifically, I am looking for any guidance, etc, on the practical application of the term "temporarily employed" within that paragraph."

Response

Please note that some of the guidance that SAAS uses to consider whether the criteria for temporary absence has been met is currently the same that can be found on our website at: - Funding for government employees abroad (saas.gov.uk)

From this you will see it states that: ‘If you normally live in the relevant area that applies to you but are currently resident outside that area and this is for temporary employment or to attend a course of study, including postgraduate research, we can treat you as if you were resident in the relevant area during this period of temporary absence.

We will ask you and your parent(s), husband, wife or civil partner to give us more information about your and their absence from the relevant area, so we can decide if it meets our temporary absence conditions.’

It also goes on to provide examples of the information we need to consider whether or not it meets the criteria.

I also attach a separate document that details our guidance when dealing with temporary absence cases.
