Electronically monitored bail breaches: FOI release
Information requested
The number of breaches of electronically monitored bail recorded since 17 May 2022. Please break this down by type of bail breach documented and the consequences of these bail breaches if known (convicted of a bail breach etc.). This should also include whether someone on electronically monitored bail is suspected of committing a crime and which crime if so. How long the average person has spent on electronically monitored bail so far.
Response
While our aim is to provide information whenever possible, in this instance the Scottish Government does not have the information you have requested. The reasons why we do not have the information are explained in the Annex to this letter. The average duration of an electronically monitored bail order since 17 May 2022 is 116 days.

The Scottish Government does not hold the information requested
The Scottish Government does not have the information you have asked for regarding the number of breaches of electronically monitored bail recorded since 17 May 2022 because the operation of bail, including breach of bail, is a matter for the independent courts and that information is not held by Scottish Government.
As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
